THE MINISTER OF STATE FOR LABOR AND EMPLOYMENT, in the exercise of the power conferred upon him by art. 87, sole paragraph, item II, of the Constitution, and art. 155 of the Consolidation of Labor Laws - CLT, and in view of the provisions of art. 1, caput, item VI, of Annex I, of Decree No. 11,779, of November 13, 2023, as well as in Process No. 19966.111465/2023-18, resolves: Art. 1º To extend until May 25, 2026, the start of the validity of the new wording of chapter "1.5 Occupational risk management" of Regulatory Standard No. 1 (NR-1) - General Provisions and Occupational Risk Management, approved by MTE Ordinance No. 1,419, of August 27, 2024. Art. 2º This Ordinance shall come into force on the date of its publication. LUIZ MARINHO What does Ordinance 1,419 of 08/27/2024 say? MTE ORDINANCE No. 1,419, OF AUGUST 27, 2024 (Published on: 08/28/2024) Art. 1 The chapter "1.5 Occupational risk management" of Regulatory Standard No. 1 (NR-1) - General Provisions and Occupational Risk Management - shall come into force with the wording contained in the Annex to this Ordinance. (...) Art. 4 This Ordinance shall come into force 270 (two hundred and seventy) days after the date of its publication. Be careful, as not all of Ordinance 1,419/2024 has been extended! Art. 2º The term "Occupational hazard or risk factor/Occupational hazard or source of risk" in "Annex I - Terms and definitions" of Regulatory Standard No. 1 (NR-1) - General Provisions and Management of Occupational Risks, shall be in force with the following wording: "Occupational hazard or risk factor: Element or situation that, alone or in combination, has the potential to give rise to injuries or health problems". (NR) Art. 3º Insert terms and definitions in "Annex I - Terms and definitions" of Regulatory Standard No. 1 (NR-1) - General Provisions and Occupational Risk Management, with the following wording: "Risk assessment: Continuous and systematic process aimed at determining the risk levels related to the hazards to which workers are exposed, their classification and judgment on the need to adopt or maintain preventive measures.
