IMMIGRATION APPEAL? WHAT HAPPENS? WHAT CAN YOU DO?

Hello everyone, this is Paul Turner the Immigration Barrister and specialist. Today I am going to be talking about what actually goes on during an appeal - this is something that is overlooked. The appeal can often be the most important day in a Migrant’s life in respect of trying to get leave to remain. If they are believed and have a good case they are likely to win, if they are disbelieved or the evidence is bad and the matter dismissed it can be very hard for an individual to win any subsequent application. It is therefore vital that any appeal is properly prepared and the witnesses / Appellant knows what to expect - I will be doing a video on what can help an appeal to succeed. My video today will be addressing what goes on in the First-Tier tribunal hearing and what can you expect from it. It is understandable that attending the court can be intimidating and stressful for people attending the court for the first time in their lives. So, if you have an upcoming immigration appeal at the First-tier tribunal and if this worries you in any way then this video is for you. Who will be in the court room? There will normally be at least four people in the courtroom at an appeal hearing, that would include you being the Appellant, your counsel, the Home Office’s lawyer, and a Judge. The Court’s clerk or the Judge’s assistant may also be present to assist the judge with administration and making sure the hearing runs smoothly, but they usually leave the court room once the hearing starts but would monitor the hearing from a different room using CCTV cameras. If you have requested for an interpreter, rest assured because the court will have arranged this on their own expense and the interpreter will be present on the hearing day. You will be allowed to bring friends, family or experts and if they are to speak to the court then they will need to be listed as witnesses prior to the hearing. However, your witnesses will not be allowed into the court until after you have finished giving your own evidence. The reason behind this is to ensure that each witness provides an impartial account, uninfluenced by what anyone else has said. They will need to wait in the waiting area and will be called in the court room. Your appeal hearing will take place in a courtroom presided over by a Judge of the First-tier tribunal, you may expect wigs and gowns, but it will not be the case since it is much less formal, the Judge will be dressed in business clothes like a suit, but they can be identified from where they sit, which is at an elevated bench looking down on the room. Before the hearing, all the paper evidence must be submitted to the tribunal and should not be kept to be produced on the hearing day. Most hearings are listed to start at 1000am, but it is important that you get there at least half a hour early. This will enable you to meet with your lawyer and hopefully relax a bit before the hearing. There is nothing worse than turning up late for a hearing. You will know what time your case has been listed for by looking at the notice of hearing letter sent to you by the tribunal.
