In this lesson we'll talk about Nationality Law, a topic that doesn't just appear... it's a major topic on the exam! NATIONALITY is the legal-political bond that links an individual to a particular State, whereby the individual becomes a member of the people, and thus acquires rights and obligations according to the legislation of their country. Nationality can be PRIMARY or ORIGINAL, which is unilaterally imposed on the individual by the country at the time of birth; it is INVOLUNTARY. We also have SECONDARY or ACQUIRED nationality, that is, after birth the individual expresses their will, which is usually done through a naturalization request; it is classified as VOLUNTARY. Another thing is the criteria established in the Federal Constitution to define whether an individual is a native-born Brazilian, which are IUS SOLIS, meaning "of the soil," that is, if born in Brazilian territory, one is, as a rule, a native-born Brazilian, and IUS SANGUINIS, which is defined as "of blood," and establishes that the child of a Brazilian father or mother is a native-born Brazilian, regardless of the place of birth.
