Prior to his arrest, Mwenda had purportedly handled 26 cases before High Court Judges, Magistrates, and Court of Appeal Judges, all of which he allegedly won. The Law Society of Kenya Nairobi Branch Rapid Action Team (RAT) took action after receiving complaints from the public, revealing that Mwenda lacked the necessary license to practice law in Kenya. He had allegedly assumed the identity of a licensed lawyer with a similar name, essentially taking over their profile on the Law Society of Kenya portal. Many are left questioning the mechanisms that allowed this deception to persist for so long and the reasons for the delayed arrest.
