Constitutional Court Justice Luz Pacheco commented on the divided ruling by the full court that granted Vladimir Cerrón's habeas corpus petition and overturned the court orders mandating his pretrial detention. During an interview on the program "Esta Noche," Pacheco clarified that, in her opinion, the Constitutional Court's ruling does not support the idea that a person can disobey a court order or go into hiding under the pretext of defending themselves against alleged injustice. "It is not true, it is not accurate to say that the court is condoning this type of behavior," she stated. The justice explained that she voted against the ruling because she believed there was sufficient justification for Cerrón's pretrial detention. She indicated that the court orders had detailed the reasons why it was not possible for the leader of Perú Libre to face trial while free. According to Pacheco, Cerrón's actions were contrary to the administration of justice. Pacheco acknowledged that there is an overuse of pretrial detention in the country and that this contributes to prison overcrowding. However, she maintained that this problem does not justify disregarding a court order. “If we want to live in democratic institutions, we have to obey the authorities,” she stated. The judge also rejected the interpretation that a person can go into hiding if they consider a pretrial detention order arbitrary. Along these lines, she recalled cases of political figures (Ollanta Humala and Keiko Fujimori) who faced legal proceedings while in custody and maintained that challenges should be made through the mechanisms that democracy provides. LUZ PACHECO QUESTIONS CERRÓN'S REQUEST TO BALCÁZAR Later, Pacheco was asked about Vladimir Cerrón's request to President José María Balcázar to release Pedro Castillo and grant safe passage to Betssy Chávez. The judge stated that one of the reasons she believed Cerrón should not be free was his role as secretary general of the president's party. Finally, Pacheco stated that Balcázar must act as president of all Peruvians and not according to partisan interests.
