8 - Competência da Justiça do Trabalho

The material jurisdiction of the labor court is an extremely important topic for the bar exam. This topic is addressed in Article 114 of the Federal Constitution: Article 114. The Labor Court is responsible for processing and adjudicating: I. Actions arising from the employment relationship, including entities governed by external public law and the direct and indirect public administration of the Union, States, Federal District, and Municipalities; II. Actions involving the exercise of the right to strike; III. Actions concerning union representation, between unions, between unions and workers, and between unions and employers; IV. Writs of mandamus, habeas corpus, and habeas data, when the act in question involves matters within their jurisdiction; V. Conflicts of jurisdiction between agencies with labor jurisdiction, except as provided in Article 102, I, o; VI. Actions for compensation for moral or patrimonial damages arising from the employment relationship; VII: actions related to administrative penalties imposed on employers by labor relations oversight bodies; VIII: the enforcement, ex officio, of the social contributions provided for in Article 195, I, a, and II, and their legal additions, resulting from the judgments issued; IX: other disputes arising from the employment relationship, as provided by law.
