TNU THEME 187 | EXEMPTIONS FROM SOCIAL EXPERTISE IN BPC Few people know, but the National Uniformization Panel, TNU, has already ruled on the conditions under which proof of indigence is unnecessary, according to TNU Theme 187. The thesis was established and the following was considered: (i) For administrative requests made from November 7, 2016 (Decree No. 8,805/16), in which the denial of the Continuous Benefit by the INSS occurs due to the non-recognition of the disability, the production of proof of indigence in court is unnecessary, except in cases of specific and substantiated challenge by the social security agency or the lapse of a period exceeding 2 (two) years from the administrative denial; (ii) For administrative requests prior to November 7, 2016 (Decree No. 8,805/16), in which the INSS's denial of the Continuous Benefit occurs due to the non-verification of the disability, proof of indigence in court is not required when it has been recognized administratively, provided that there is no specific and substantiated objection from the social security agency and no more than 2 (two) years have elapsed since the administrative denial.
