Part 8 applies to children under 18 joining a parent or parents who are present and settled in the UK, including those with Indefinite Leave to Remain (ILR) or British citizenship. Previous Rules, More Flexible Settlement Options Before 26 March 2026, children could be granted indefinite leave to enter in several situations, including: ✔️ Both parents settled in the UK ✔️ One parent with sole responsibility, or the other parent deceased ✔️ “Serious and compelling circumstances” making refusal undesirable The old rules were more flexible regarding the immigration status of the other parent. The Kone Case & Home Office Update A recent Court of Appeal case (Kone) highlighted gaps in Part 8. Following this, the Home Office updated the rules, restricting ILR eligibility when one parent has limited leave in the UK. Key Changes From 26 March 2026 If one parent is settled but the other parent has limited leave, a child cannot apply for indefinite leave to enter, even if there are compelling circumstances. Eligibility Summary: ✔️ Still possible: Both parents settled or being granted settlement ✔️ Potentially possible: One parent settled, the other does not have limited leave, with serious and compelling reasons ❌ No longer possible: One parent settled and the other parent has limited leave Alternative Options for Children Even if indefinite leave to enter is unavailable, children may qualify for limited leave to enter under Appendix FM as a dependant, depending on the parent’s immigration status.
