A professional soldier is released from professional military service as a result of: 1) renunciation of Polish citizenship; 2) election as a member of parliament, including the European Parliament, senator, elected managerial position in a state office, or appointment to the executive bodies of local government; 3) determination by a military medical board of incapacity for service; 4) refusal to accept a referral to a military medical board or unjustified failure to report to such board at the specified ©Chancellery of the Sejm p. 152/510 2022-05-20 date and place, or failure to undergo examinations required by the medical board; 5) reaching the age of 60, subject to Article 227; 6) receiving an unsatisfactory overall grade in a service assessment; 7) submitting an untrue vetting declaration; 8) refusal to serve in an equivalent or higher official position; 9) expiry of the notice period for professional military service terminated by a professional soldier; 10) failure to be assigned to a service position while on active duty; 11) loss of military rank or demotion; 12) a final judgment imposing a disciplinary penalty of removal from professional military service; 13) a final judgment imposing criminal penalties involving deprivation of public rights, expulsion from professional military service, or a ban on practicing as a professional soldier; 14) a final court judgment imposing a sentence of imprisonment or military detention without conditional suspension of its execution; 15) a final punishment imposed by a competent professional self-government body imposing a penalty of suspension or deprivation of the right to practice a profession (professional specialty), provided that the soldier cannot be assigned to another official position; 16) a single absence from duty for a period of three working days, which is unjustified. Art. 228. 1. A professional soldier may be dismissed from professional military service as a result of: 1) a final judgment imposing a sentence of imprisonment or military detention with conditional suspension of the execution of this sentence; 2) a refusal to issue or revoke the soldier's required security clearance; 3) failure to assign the soldier to a subsequent official position; 4) receiving a satisfactory overall assessment in the service evaluation; 5) the need for the Armed Forces arises – with the soldier's written consent; 6) being sentenced by a final judgment to a penalty of restriction of liberty, imprisonment, or military detention; 7) removal of a professional soldier during the education referred to in Article 95, paragraph 4, from the list of those undergoing education due to failure to meet the requirements specified in the regulations for education or studies; 8) conduct that violates the soldier's dignity or honor or is incompatible with the dignity of service and is detrimental to the good name or interests of the Armed Forces; 9) expiry of 12 months of suspension from official duties, if the grounds for suspension have not ceased; 10) committing an act constituting a crime or a tax offense, if the act is obvious and prevents further service; 11) 12 months have passed since the date of cessation of service due to illness or a stay in a hospital or other healthcare facility providing medical services such as inpatient and 24-hour healthcare services, and the absence of the conditions referred to in Article 18 of the Act of 25 June 1999 on cash benefits from social insurance in the event of illness and maternity (Journal of Laws of 2021, items 1133, 1621, and 1834); #dismissalfromthemilitary #howisthemilitary #militarypolishmilitary
