Ep 12: Wicked Problems and Labour Law - The Law Isn’t Always the Wizard
In this episode of the Labour Justice Barometer, we are joined by Marius van Staden, Professor at Wits School of Law. (https://www.wits.ac.za/people/academi...) His research expertise encompasses Labour Law and Employment Rights, Statutory Interpretation, Constitutional Law and Human Rights, Workplace Discrimination and Equality, and Vulnerable Workers and Social Protection. His scholarship has significantly contributed to understanding the intersection of labour law with broader socio-legal issues in South Africa. He joins us to discuss his forthcoming article, `'Wicked Problems in Labour Law." Drawing on insights from policy theory, the article introduces the concept of “wicked problems,” complex social challenges that involve competing interests, contested definitions, and solutions that often produce new and unintended consequences. We explore how this framework helps explain why some labour law issues cannot be resolved through traditional legal tools alone. Watch this space for Marius’s article. Please feel free to reach out to him (mailto:[email protected]) directly for more information.
