No. 1️⃣3️⃣6️⃣7️⃣3️⃣). ❇️ The draft law is aimed at ensuring the legal regulation of the liability of persons for crossing the state border of Ukraine in order to evade conscription for military service during mobilization, establishing the grounds for exemption from this liability during martial law, as well as bringing the provisions of the Code of Ukraine on Administrative Offenses into line with the decision of the Constitutional Court of Ukraine dated October 12, 2022 No. 8-р(І)2022. The draft law proposes: ✅ to exclude Article 204-3 of the Code of Ukraine on Administrative Offenses (due to its partial unconstitutionality and ineffectiveness); ✅ to transfer the authority to consider cases of administrative offenses provided for in Article 204-1 of the Code of Ukraine on Administrative Offenses (regarding illegal crossing of the state border) to the state border guard agencies; ✅ to supplement Article 332 of the Criminal Code of Ukraine (illegal crossing of persons across the state border) with a qualifying feature in the form of committing a criminal offense under martial law; ✅ to establish criminal liability for: illegal crossing of the state border under martial law or a state of emergency outside state border checkpoints (Part Four of Article 332-2 of the Criminal Code of Ukraine); obstruction of the development of border infrastructure, its damage or destruction (Article 332-3 of the Criminal Code of Ukraine); violation by a conscript, military conscript or reservist of the established period of stay outside Ukraine (Article 337-1 of the Criminal Code of Ukraine); ✅ to establish grounds for exemption from criminal liability provided for in Part Four of Article 332-2 and Article 337-1 of the Criminal Code of Ukraine, as well as to establish a special pre-trial investigation under these articles; ✅ establish the obligation for military servicemen (conscripts, reservists) to comply with the period of stay outside Ukraine.
