Antônio Decaro Júnior, a retired police officer, sought to cancel the maintenance of his water purifier, relying on Article 49 of the Consumer Protection Code, which guarantees the consumer the right of withdrawal. That is, it allows him to cancel purchases or contracts made outside of a commercial establishment (internet, telephone, home) within 7 days, without needing justification and with the right to a full refund. However, he faced difficulties with the company responsible, which did not respond to his cancellation requests made by phone and WhatsApp. The company continued to charge for the new equipment and failed to send a technician for the scheduled service on several occasions.
