The prohibition of concerted practices and agreements, also known as anti-cartel law, is one of the four main branches of European competition law and plays a role in the proper functioning of the European internal market. Article 101(1) TFEU generally prohibits all agreements between undertakings, decisions by associations of undertakings, and concerted practices which have as their object or effect the prevention, restriction, or distortion of competition in the internal market. It sets out a non-exhaustive list of prohibited practices: • fixing purchase or selling prices or other trading conditions, • limiting or controlling production, markets, technical development, or investments, • sharing markets or sources of supply, • applying unfair conditions to trading partners, • making contracts conditional on the acceptance of additional services unrelated to the subject matter of the main contract. Exceptions to this general prohibition are provided for in Article 101(3), in particular when the agreement or practice in question contributes to improving the production or distribution of products or to promoting technical or economic progress, while reserving for consumers a fair share of the resulting benefits. → The restrictions on competition must be indispensable to achieve these objectives, and the agreement must not give the parties the opportunity to eliminate competition for a substantial part of the products concerned. Block exemption regulations adopted by the European Commission also define the categories of exempted agreements.
