Romania is the latest European country to introduce groundbreaking regulations regarding trailer loading and unloading – the new law comes into effect on July 24th. Under the new regulations, professional drivers operating vehicles with a GVM exceeding 12.5 tons cannot be forced by the shipper, consignee, or freight forwarding agent to reload goods. Any contractual clauses requiring the driver to do so will be null and void. This article explains the mechanism of the new transport regulations in Romania, the exceptions provided (including voluntary written consent from the driver and specialized transport), and the penalties for parties attempting to circumvent the ban – ranging from 5,000 to 20,000 lei, or approximately 4,000 to over 16,000 PLN. We also remind you how a similar problem—long waits at the loading dock, disputes over liability for goods, and the threat of a truck driver strike—was previously resolved in Spain, where the fine for violating the ban is €4,600.
