An ad hoc mandate is a procedure consisting of the appointment of an agent to assist the manager of a company in difficulty in order to avoid bankruptcy. This is a preventive, confidential procedure, initiated solely by the manager of a company experiencing difficulties. (Art. L611-3 and L611-15 of the French Commercial Code) A manager seeking the assistance of an agent must submit a written and reasoned request to the president of the competent court (judicial or commercial, depending on the company's activity), attaching all of the company's accounting documents. (Art.
