Anyone who bought a property in the last five years has a very high chance of having overpaid ITBI (Property Transfer Tax). And we're not talking about a small amount of money: it's a tax that can reach 3% of the property value, calculated in a way that the Superior Court of Justice (STJ) has already declared illegal. In this video, I present three legal arguments regarding ITBI that are currently being debated in the Judiciary, with consolidated jurisprudence, favorable trends, and open opportunities for tax lawyers. ✅ STJ Case 1113 has already established that municipalities cannot charge ITBI based on their own table. But city halls continue to do so. Where is the client in this case? ✅ Supreme Court Case 796 set the limits of ITBI immunity in the capitalization of companies. Why are municipalities misinterpreting this decision and charging what they cannot? ✅ Supreme Court Case 1348 discusses immunity in real estate holding companies, and the judgment is not yet finished.
