The distribution of the global limits of art. 19 may not exceed the following percentages: I - at the federal level: a) 2.5% (two and five tenths percent) for the Legislative Branch, including the Federal Court of Auditors; b) 6% (six percent) for the Judiciary Branch; c) 40.9% (forty and nine tenths percent) for the Executive, with 3% (three percent) for personnel expenses arising from the provisions of items XIII and XIV of art. 21 of the Constitution and art. 31 of Constitutional Amendment 19, distributed proportionally to the average expenses related to each of these provisions, as a percentage of net current revenue, verified in the three financial years immediately prior to the publication of this Complementary Law; d) 0.6% (six tenths percent) for the Federal Public Prosecutor's Office; II - at the state level: a) 3% (three percent) for the Legislative, including the State Court of Auditors; b) 6% (six percent) for the Judiciary; c) 49% (forty-nine percent) for the Executive; d) 2% (two percent) for the State Public Prosecutor's Office;    III - at the municipal level: a) 6% (six percent) for the Legislative Branch, including the Municipal Court of Auditors, when applicable; b) 54% (fifty-four percent) for the Executive Branch. § 1º In the Legislative and Judicial Branches of each level, the limits will be divided among their bodies in proportion to the average personnel expenses, as a percentage of net current revenue, recorded in the three financial years immediately prior to the publication of this Complementary Law. § 2º For the purposes of this article, the following bodies are understood as: I - the Public Prosecutor's Office; II - in the Legislative Branch: a) Federal, the respective Houses and the Federal Court of Auditors; b) State, the Legislative Assembly and the Courts of Auditors; c) of the Federal District, the Legislative Chamber and the Court of Auditors of the Federal District; d) Municipal, the City Council and the Municipal Court of Auditors, when applicable; III - in the Judiciary: a) Federal, the courts referred to in art. 92 of the Constitution; b) State, the Court of Justice and others, when applicable. § 3º The limits for spending on personnel of the Judiciary, which are the responsibility of the Union by virtue of item XIII of art. 21 of the Constitution, shall be established by applying the rule of § 1º. § 4º In States where there is a Municipal Court of Auditors, the percentages defined in items a and c of item II of the caput shall be, respectively, increased and reduced by 0.4% (four tenths of a percent). § 5º For the purposes provided for in art. 168 of the Constitution, the allocation of financial resources corresponding to the total personnel expenses per Branch and agency will be the result of the application of the percentages defined in this article, or those set in the budget guidelines law. § 7 The Branches and agencies referred to in this article must determine, in a segregated manner for the application of the limits set forth in this article, the full personnel expenses of their respective inactive civil servants and pensioners, even if the cost of these expenses is the responsibility of another Branch or agency.
