Registration as Tour operator or Travel agent Since the summer is coming, more and more inquiries are being made to us regarding the registration of clients as tour operators or travel agents in Bulgaria. For that reason, we decided to publish an article, giving basic information about this type of certificates, which are issued under the Bulgarian Tourism Act. 1. What is a tour operator? A tour operator is a company which offers travel packages and sells or offers them for sale directly or through another trader. The tour operator has the right to prepare travel packages offered for sale for tourism, recreation, entertainment, business, participation or attendance at events of cultural and educational nature, congresses and business events or for other purposes. A tour operator can only be a registered company (OOD, EOOD, AD, EAD, etc.) which has a Certificate for tour operator and/or travel agency, and is registered in Bulgarian Register of Tour Operators and Travel Agents. 2. What is a travel agent? A travel agent is a legal entity which sells or offers for sale travel packages prepared by a tour operator. The agent only mediates in the sale of travel packages to end users; passenger air, water and bus transport; reservation, visa and other additional tourist services, as well as insurance related to tourist travel. A travel agent can also be only a registered company (OOD, EOOD, AD, EAD, etc.) which has a Certificate of Travel Agency and is registered in Bulgarian Register of Tour Operators and Travel Agents. 3. Legal requirements for tour operator and agent The most important requirements, that the tour operator or the agent must meet in order to obtain a Certificate, are: to has an office and/or an online platform for carrying out the activity, staff with the required education and language qualification, and for the management staff work experience is required; to has a valid insurance; to has no obligations for taxes and social security contributions; the owner and the manager of the company have not been convicted and have not been deprived of the right to hold a materially responsible position. 4. Procedure for obtaining a Certificate Certificate for tour operator and/or travel agency is issued by Bulgarian Ministry of Tourism. The application documents are reviewed within 14 days. If there are irregularities in the documents, a period of another 14 days is provided for their elimination. The issued certificate is for indefinite period of time. Certificate rights may not be transferred or assigned except in certain cases. For example, in the case of transformation by merger, amalgamation, division, separation, change of legal form, transfer of a commercial enterprise or inheritance, if the person to whom the rights are transferred or transferred meets the conditions for entry in the register. The issued Certificate shall be put in a prominent place in the office or on the website of the tour operator/ travel agent. State fees are collected for the documents review, entry in the Register of tour operators and travel agents and for supplementing and/or amending the registration according to the Tariff.
