Section 80 of the Code of Civil Procedure, 1908, is one of the most significant procedural safeguards in Indian civil law. It saves public funds and reduces the burden on courts. This ensures they are not dragged into litigation without due process. Courts have consistently emphasized that Section 80 is not a mere formality but a mandatory requirement.
