Introduction Parties to an action is one of the preliminary issues that must be considered before an action is instituted in court. The right parties and in the proper capacities must be before the court otherwise the case will fail. In other words, if the right parties and in the proper capacities are not before the court, the jurisdiction of a court will be challenged and the court will have no option but to decline jurisdiction otherwise the decision of the court will be a nullity. This class introduces the topic “parties to an action” under civil litigation as well as types of parties to an action and capacity to which parties can sue and be sued.
