Investor-State Arbitration and the Global South
This event examined the evolving relationship between investor-State dispute settlement (ISDS) and countries of the Global South. It explored the practical and systemic effects of ISDS on developing and emerging economies, including financial exposure, regulatory space, and policy autonomy. Particular attention was paid to managing counsel, controlling costs, and building in-house capacity to handle complex arbitration proceedings effectively. The discussion addressed ongoing reform efforts at the multilateral and regional levels, highlighting opportunities for greater balance, transparency, and inclusiveness in the system. Speakers included representatives of governments, leading law firms, and academia, offering diverse institutional and regional perspectives.
