Tyler Robinson Prelim: The 3 Days of Evidence Everyone Is Talking About
Tonight I am breaking down the first three days of the Tyler Robinson preliminary hearing in the Charlie Kirk case, and I am doing it the way I do everything on this show: with the actual courtroom testimony in front of me, not the headlines. Over three days in a Utah courtroom, prosecutors put on their evidence to convince Judge Tony Graf there is enough to send Robinson to trial on aggravated murder and additional counts, including three victim-targeting enhancements, with the state seeking the death penalty. Robinson has not entered a plea and is presumed innocent. Everything the state described is an allegation it still has to prove. My job tonight is to separate what was actually established from what is still just argument. Here is what we get into. The surveillance video the state calls its spine: the Chick-fil-A stop, the clothing change, the limp that appears and then disappears, and the low crawl across the Losee Center roof. The DNA fight, where the state's "30 quintillion" number runs straight into the defense line "she can't match Mr. Robinson," and the FBI analyst's own admission of potential human error. The crime scene testimony from Day 1: the "sniper pad," the screwdriver, the empty holster nobody logged, and the public stairway that led to the roof. And the Day 3 procedural battle over the roommate's immunized recorded interview, the proposed redactions, and what the state is calling a confession. I will also tell you where I think the coverage got it wrong, starting with the DNA, because a likelihood ratio on a two-person mixture is not the fingerprint-style match people think it is.
