In this work, Montesquieu proposes a theory of separation of powers, which is fundamental to the political organization of many modern countries. He argues that in order to avoid tyranny and oppression, it is necessary to divide power into three distinct branches: legislative, executive and judiciary. Each branch must have limited powers and be independent of the others, in order to avoid abuse of power. In his work “The Spirit of the Laws”, Montesquieu proposed the theory of separation of powers, in a tripartite division, between executive, legislative and judiciary. Before Montesquieu, the theory of separation of powers had already been thought of by Aristotle, in his work called “Politics”, and also by the Englishman John Locke (who was a great inspiration for Montesquieu). However, although the theory was initiated by Aristotle and John Locke, the reason why Montesquieu is credited with establishing the theory of separation of powers is because he brought the division of powers of each power, with the contours of each function, exerting enormous influence to this day. Each power has its responsibilities, in addition to monitoring each other, preventing abuse and the concentration of power.
