A Strategic Rethink: Congress Versus the President on US Trade Policy

In the aftermath of the Smoot–Hawley Tariff Act of 1930, it became apparent that Congress might be poorly suited to manage US trade policy on its own. In the century since, the legislature has delegated some of its constitutionally enumerated authorities to the president under the belief that the executive branch could effectively represent US interests in trade negotiations while Congress gives input and ultimate approval. Does this premise still hold today? The second Trump administration’s actions strongly suggest that the delicate trade policy relationship between Congress and the executive is ripe for a strategic realignment.
