Cummins Employee With Diabetes Denied by Unum After 5 Years Wins Disability Appeal

Unum denied long term disability benefits for a Cummins Service Supervisor after paying his claim for nearly five years, and Dell Disability Lawyers got the denial reversed by using Unum's own evidence against them. Our client was a Service Manager and Supervisor at Cummins, the global diesel engine manufacturer, where he held a physically demanding role that was not sedentary. At the end of 2021, he suffered a heart attack that required bypass surgery. Following surgery, he developed atrial fibrillation (AFib), stage 3 chronic kidney disease, and type 2 diabetes — conditions that compounded over time and left him unable to work. Unum approved his disability claim and paid benefits for almost five years, acknowledging he was disabled from both his own occupation and any occupation. During that time, Unum encouraged him to apply for Social Security disability, which he was awarded. Then, after nearly five years of payments, Unum conducted a single paper review and terminated his benefits, claiming he could perform sedentary work. Unum's denial contained a critical internal contradiction that attorney Cesar Gavidia identified by reviewing the complete claim file. Unum's own vocational expert recommended specific alternative occupations — including dispatcher and other roles — that our client supposedly could perform. However, the physical demands of those very jobs exceeded the restrictions and limitations that Unum itself had accepted in our client's file. By Unum's own standards, he could not meet the requirements of the occupations their vocational analyst identified. On top of that, the alternative jobs did not match his transferable skills, and Unum had suggested occupations he had never performed and had no training for. If Unum denied your long term disability claim after years of paying benefits by suggesting jobs that contradict your own documented restrictions, this case demonstrates how experienced disability insurance attorneys find the flaws in Unum's own file. Dell Disability Lawyers built an appeal that turned Unum's evidence against them. Gavidia hired an independent vocational expert to analyze the report Unum's vocational analyst had produced and demonstrated that the suggested occupations were inconsistent with the limitations Unum had already accepted. The medical records and treating physician support were already strong — this was not a case of sparse documentation — so rather than ordering additional testing that would have been redundant, Gavidia focused the appeal on dismantling the logical disconnect in Unum's own review process. Unum reversed its denial within 45 days and reinstated benefits. Dell Disability Lawyers continues to manage this claim on an ongoing basis. 00:00 Introduction & Today's Case 00:34 Claim Background & Client's Medical History 01:57 Receiving Disability, Then Unexpected Denial 02:46 Difference Between Disability Insurance & Social Security 03:53 Medical Support & Limits of the Client 04:58 Unum's Paper Review & Vocational Assessment 05:58 Challenging the Denial with Vocational Evidence 06:48 Using Unum's Own Evidence to Win the Appeal 07:13 ERISA Laws & Accessing Claim Files 08:38 Winning the Appeal Efficiently 10:02 Ongoing Claim Management & How We Help 10:34 Final Tips & Free Consultation For an immediate free consultation with one of our nationwide disability insurance lawyers please 📞 call 800-698-9161 or 💻 email https://www.diattorney.com/contact/?r....
