Lawyer Ndegwa Njiru says Gachagua’s impeachment was a Mockery of justice

In a dramatic constitutional showdown, lawyer Ndegwa Njiru told the court that the Senate impeachment proceedings against Deputy President Rigathi Gachagua were not just legally defective, but a “mockery of justice” and a direct attack on the Constitution itself. Addressing the bench, Njiru argued that the case transcends politics and touches on the very foundation of Kenya’s democratic order, constitutional supremacy, and the sovereign will of the people. Relying heavily on the Constitution’s preamble, the lawyer said Kenyans envisioned a government grounded in democracy, equality, social justice, human rights, and the rule of law. He maintained that impeachment is an extraordinary constitutional mechanism that should only be invoked as a last resort, especially against a Deputy President who, unlike the President, does not enjoy immunity from criminal or civil proceedings. According to the defence, if there was evidence of wrongdoing, ordinary legal processes should have been pursued instead of what he described as a politically charged impeachment process.
