During the proceedings, the Libero Consorzio Comunale (Free Municipal Consortium) had objected to the inadmissibility of the appeal, challenging the appellant teachers' standing to sue. This request, they explain, was not accepted by the Administrative Justice Council during the interim phase. The judges, in fact, deferred the evaluation of these objections to the subsequent merits phase, thus not excluding the possibility that the appellants' arguments will be examined in detail. For the Committee, this point is particularly significant because it demonstrates that the proceedings remain fully open and that none of the key issues have been definitively resolved. The considerations contained in the order regarding the balance between the interest in maintaining the current location and the need to contain public spending are also interpreted as considerations limited exclusively to the precautionary phase. In the Committee's view, these observations neither anticipate nor influence the future decision on the merits of the appeal, which will also examine aspects relating to the alternative solutions proposed by the school community, which, according to the appellants, were not adequately assessed by the institution. The association reiterates that its initiative stems not only from the desire to preserve the historical value of the Rizza Institute, but also from the need to ensure transparent management of public resources. In particular, attention is drawn to the need for the Libero Consorzio, especially in light of its financial situation, to demonstrate with objective data, economic analyses, and administrative documents that the relocation truly represents the most cost-effective solution. The Committee therefore continues to call for the comparative studies on the expected costs to be made public, for the suitability and safety of the site chosen on Via Modica to be verified, and for every decision to be made through a process characterized by maximum transparency and the involvement of all stakeholders. "The protection of the Rizza Institute's history and the proper management of public resources are not conflicting objectives," the Committee emphasizes, reiterating its request to demonstrate, before proceeding with definitive and difficult-to-reverse decisions, that the relocation is truly necessary, economically advantageous, and fully compliant with safety and functionality requirements. The legal battle, the promoters of the initiative conclude, is far from over and will continue in the relevant jurisdictions until a final decision is reached.
