It is used in legal proceedings to contest a first instance decision, that is, a sentence given by a judge. Today you will understand what an appeal is, how it works and its importance in Law. First, it is essential to understand that in Brazil, the judicial system is divided into several instances. The first instance is where the case begins and is initially judged. If one of the parties involved in the case does not agree with the sentence given by the first instance judge, they can appeal this decision. An appeal is precisely this recourse. An appeal is the resource used to contest the sentence. There is a disagreement on the part of the party in relation to what was decided, because they believe they were wronged, thus seeking to change what was judged. An appeal is used to question a sentence that ended the case in the first instance. It can address questions of fact and questions of law. When a party files an appeal, the case is sent to a second instance court. There, a group of appellate judges (who are the second instance magistrates) will read the case and the sentence. They can confirm the decision, partially change it, or even change it completely. One of the principles of appeals is the double degree of jurisdiction, which ensures that judicial decisions can be re-examined. We have the devolutive effect, which would be to “return” the contested matter so that the Court can make another decision.
