The "Invisible" Shift: How I Won the Room After the Prosecutor Sat Down
Join this channel to get access to perks: / @formanlaw This was a jury trial I conducted by myself from beginning to end on November 5, 2025. Our client refused a blood draw warrant issued by a Hardin County Judge, and as a result, he was charged with 6 charges: 1) Obstructing Government Operations (for which the maximum sentence is a year incarcerated) 2) DUI 1st Offense; 3) Reckless Driving; 4) Failure to wear a Seatbelt; 5) No insurance; and 6) Failure to notify address change. This case was tried in front of Judge Shaw, Hardin County District Court Division I, on November 5, 2025. Larry Forman was the lead defense attorney. Here is what Trooper Grant wrote in his citation: "I observed the above vehicle while at the five star gas station in Vine Grove. The vehicle braked as if it was going to enter the gas station at the front entrance, near where I was in my marked state police cruiser, and then went around the back of the gas station. It then entered the gas station from the back entrance and pulled halfway into a parking space. I then pulled around the gas station, behind the vehicle to exit the gas station. At this time, while I was behind the vehicle the vehicle then pulled fully into the parking space. LINK/NCIC [National Crime Information Center] advised the vehicle had no insurance. As I pulled out onto 313, I observed the operator of the vehicle standing outside of his vehicle, watching me as I left. This behavior, based on my training and experience, is indicative of being evasive and criminal activity being afoot. I then observed the vehicle on 313. As soon as I got behind the vehicle, it then made a right hand turn onto 1500, Rogersville RD. At this time, I observed the vehicle swerve across the centerline into the oncoming lane and swerve back into its lane of travel. I conducted a traffic stop at this time and made contact with the above operator at the passenger side window. I could immediately smell the distinct odor of alcoholic beverages coming from the vehicle. I observed that the operator had no seatbelt on and had red bloodshot eyes. He produced a Florida Driver's license for identification and later stated that he has lived in Louisville for over a year. The operator was initially uncooperative when I asked him to step out of the vehicle. The operator eventually complied to step out of the vehicle and as I spoke to him I could smell the distinct odor of alcoholic beverages coming from his person. The above was slurring his words and was evasive to questioning. The operator refused to conduct SFST's and stated that he had last drank alcohol approx. 7 hours prior. The operator was then detained and read his Miranda Rights. He stated he understood his rights. Based on the totality of the circumstances, the operator was placed under arrest for DUI. I then transported the operator to the Hardin County Detention Center, where I read Implied Consent to him. He accepted his opportunity to contact an attorney. I had jail staff look up attorney phone numbers for him so he could call from a jail phone. Once the above stated he was finished with his opportunity to contact an attorney he refused a blood draw. I then presented the above with a signed search warrant for a blood sample signed by Judge Shumate. The operator then refused the search warrant. Vehicle was towed by Merciful Towing.
