#COIPReform | The current proposal, far from strengthening legal and social security, maintains a punitive model that has historically proven insufficient to guarantee social peace and the protection of the fundamental rights of the vast majority of Ecuadorians. The main problem, a conceptual issue and the structural basis of this report, is the punitive and misguided vision that claims that criminal law is the primary instrument for combating crime. This populist view ignores the constitutional foundations of our justice system: Security is not built through the indiscriminate increase of penalties or by filling prisons. The fight against crime is the result of a comprehensive public policy: prevention, intelligence, effective criminal investigation, and strengthening of the Public Prosecutor's Office and the Police. In Session No. 98, the Plenary of the Assembly reviewed the Report for the First Debate of the Draft Organic Law Amending the Comprehensive Organic Criminal Code. In her remarks, Assemblywoman Mireya Pazmiño explained that the current reform comes after a legislative consolidation process that encompassed 84 bills: “These reforms require an analysis that goes beyond simply modifying criminal offenses and focuses on the systematic coherence and effectiveness of the State's criminal policy.” It is worth noting that Assemblywoman Mireya Pazmiño was granted the floor after a six-month hiatus.
