He promised to cover the damages, but later changed his mind after consulting his insurance company. According to the Brazilian Traffic Code (CBT), there is a presumption of fault for whoever collides with the rear of another vehicle for not maintaining a safe distance or adequate attention. However, experts point out that situations such as mechanical failures can share responsibility. Mariângela and her daughter Juliana believe that the captured images clearly demonstrate the driver's recklessness in performing a sudden maneuver followed by an unexpected stop in the middle of the road. They filed a police report against him and are awaiting a response from the insurance company involved.
