História do Direito no Brasil República

In this class, I discuss the History of Law in Republican Brazil, especially the first phase of the Brazilian Republic. As main characteristics, we observe that during this period the military and the agrarian oligarchies vied for power. In the city, the middle classes and the nascent industrial bourgeoisie sought political participation. The Catholic Church was excluded from power. In the countryside, the law of the colonels prevailed. The Provisional Government established by Marshal Deodoro da Fonseca aimed to consolidate the new regime and govern until elections could be held. It aimed to approve a new Constitution and implement the various political and administrative reforms included in the republican program. The Marshal dissolved the provincial assemblies and the municipal councils. He dismissed and appointed new presidents for the provinces; a civilian and military elite began to administer Brazil; political negotiations involved several republican parties from Rio de Janeiro and São Paulo.
