The Supreme Court allocates more resources per patient than the Ricarte Soto Law. The legal mechanism, intended to resolve access to these medications, has been systematically overlooked by the court, in a way that seems to jeopardize the sustainability of the healthcare system. Year after year, Fonasa allocates more resources to comply with court rulings, inevitably neglecting coverage for other, more affordable medications or therapies that are also unavailable. What is the limit on resources that can be allocated through the courts? Does the court resolve an access problem or violate a principle of justice and equity? The answer is not simple.
