Bombshell Note: Will Utah Let the Jury Hear “Take Out Charlie Kirk?"

Utah prosecutors say Tyler Robinson left a handwritten note for his roommate before Charlie Kirk was shot: “I had the opportunity to take out Charlie Kirk and I’m going to take it.” In this video, I show you exactly where that line appears in the charging Information and break down how a Utah trial judge is likely to analyze it under Utah’s evidence rules, which closely track the Federal Rules and many other state codes. I don’t practice law in Utah, and this isn’t legal advice; I’m reading the rules as written and applying them to what’s in the public filings. We’ll cover: Rule 401 and 402: why this handwritten note is almost certainly “relevant” and therefore admissible by default. Rules 801(d)(2) and 802: how Utah treats a defendant’s own statement as “not hearsay” when the prosecution offers it against him. Rule 403: whether the emotional and political punch of “take out Charlie Kirk” is so unfairly prejudicial that a judge should still keep it from the jury.
