Blizzard vs Project Ascension: 4 Days Before BlizzCon

Derek Powell and three other defendants waived formal service. Counsel has now appeared for Derek, and Blizzard withdrew its ex parte early-discovery application on July 10. The court did not deny that request, and the docket does not explain why Blizzard withdrew it. Ordinary discovery can still happen later. On the current schedule, Derek’s answer or Rule 12 motion remains due September 8, 2026—four days before BlizzCon begins. Episode 4 follows the promise at the end of “Show Receipts.” Blizzard repeatedly makes allegations against “Defendants” as a group. Liability against Derek still requires evidence showing what Derek personally controlled, directed, received, knew, or did. The complaint uses “Defendants” 196 times. Powell’s surname appears 14 times in the body. Those numbers do not decide the case. They give us a map for checking what Blizzard actually attaches to Derek.
