Warum auch ein Mörder ein Recht auf Verteidigung hat: Interview mit Prof. Dr. Holm Putzke
Recently, there has been a surge in reports of people being randomly attacked and—even worse—killed in the streets. Simply reading such news makes it difficult to comprehend that even such an attacker has the right to be defended. And yet, our legal system is designed to provide for this. Why this is the case and what unique aspects of German criminal law are discussed with my interview guest this week: Professor Dr. Holm Putzke, Professor of Criminal Law at the University of Passau and a criminal defense attorney. Holm Putzke not only teaches the fundamental normative principles of criminal law, thus contributing to the training of tomorrow's lawyers, but he also practices criminal defense law himself and knows what it's like to defend clients in court. In our conversation with Holm Putzke, we first discuss the general principles of the rule of law in our public order, the particular importance of a fair trial and a neutral state, and also the criminal law component in the corporate context. Holm Putzke also discusses how crucial it is to separate empathy and moral feelings from the application of the law in order to provide the best possible defense for a defendant.
