Foundational text of the doctoral contract. Article 8 provides for automatic extension in the event of maternity leave, provided that the request is made before the expiration of the initial contract. Decree No. 86-83 of January 17, 1986. Governs state contract employees. Article 19 of this decree governs maternity/paternity leave for doctoral contract employees, subject to a one-year seniority requirement. Order of May 25, 2016. Establishes the national framework for doctoral studies. Article 14 specifies that if the doctoral student has taken maternity leave, the duration of doctoral studies is extended by a period equal to the leave period, upon request of the student. Circular of November 29, 2016. Specifies the implementation procedures. Article D412-9 of the Research Code. Explicitly provides for the possibility of extending the duration of the doctoral contract in the event of maternity leave. CIFRE (private law) Articles D. 1242-3 and D. 1242-6 of the Labor Code. Govern the CIFRE employment contract. The ANRT's general terms and conditions stipulate that the CIFRE grant and its payment may be suspended in the event of maternity leave, and that upon return to work, the CIFRE grant is extended by the duration of the suspension. Note: the ANRT grant is suspended during the leave, and the fixed-term contract with the company cannot be renewed. Therefore, the university must agree to extend the grant to take over. Doctoral students without funding: The decree of May 25, 2016, applies to unfunded doctoral students. Maternity leave is available in universities, but the specific arrangements vary from one institution to another. There is no automatic mechanism. Everything is based on the institution's doctoral charter. Discrimination: Articles L. 1132-1 et seq. of the French Labor Code. Discrimination related to pregnancy is prohibited for female employees (CIFRE grants). Law No. 83-634 of July 13, 1983 (General Civil Service Statute). Equivalent protection for public-sector contract employees. The Defender of Rights is the point of contact in cases of discrimination.
