A criminal hearing is one of the most important evidentiary activities a participant may encounter. Regardless of whether you are a witness or a suspect, it is not a casual exchange with an officer, but a formal procedural act conducted under the provisions of the Code of Criminal Procedure. Everything said is recorded in the record and can have a real impact on the further course of the case. My name is Agnieszka Grzywka-Kulas, an attorney, and for years I have represented clients in criminal proceedings, both at the pre-trial stage and in court. In this video, I explain how to approach a hearing safely and what mistakes are most often made early in the proceedings. In the video, I explain why it is crucial to correctly determine your procedural status and the consequences of being questioned as a witness and as a suspect. I also discuss the differences in rights, obligations, and entitlements, including the right to refuse to testify, the right to refuse to answer specific questions, and the right to remain silent. From my own experience, I demonstrate how often problems arise from hasty statements, a lack of awareness of the legal consequences of one's words, and signing the transcript without thoroughly reading it. I explain why the transcript of a hearing is crucial as evidence, how to read it, when and how to raise objections, and why signing the transcript confirms its content. I also address the issue of the involvement of a defense attorney or attorney during the pre-trial phase. I explain the actual role of a lawyer during a hearing, why the presence of a professional attorney is especially important when access to records is limited, and in what situations a witness should also consider appointing an attorney.
