12 NAJWAŻNIEJSZYCH ORZECZEŃ 2025 ROKU.

In a special episode of my video podcast, I invite you to a summary of 2025. I present the most important judgments from domestic and foreign courts – a sort of TOP 12. This list includes: 1. Judgment of the Supreme Court of 17 June 2025, Criminal Chamber (ref. II KK 462/04) – following a cassation appeal by the Commissioner for Human Rights, the Supreme Court established specific standards regarding the quality of the legislative process and the impact of defectively adopted provisions on criminal liability. 2. Bradshaw and Others v. United Kingdom (July 22, 2025, ECHR) – the Strasbourg Court addressed the standards for conducting investigations related to illegal interference in parliamentary elections by external forces (including Russian disinformation). 3. Ewa Siedlecka v. Poland (2025, ECHR) – the Strasbourg Court found that detention in a so-called police cell can constitute an unacceptable interference with personal liberty. 4. AW "T" (CJEU judgment of 4 September 2025, C-225/22). The Court of Justice in Luxembourg examined the effects of judgments of the Extraordinary Control and Public Affairs Chamber of the Supreme Court under EU law and found them to be non-existent in the European legal order. The judgment provides clear guidance for national courts to review judgments issued with the participation of judges appointed after 2018, examining the independence of adjudicating panels in accordance with the principle of effectiveness of EU law. 5. Resolution of a seven-judge panel of the Labour and Social Security Chamber of the Supreme Court of 24 September 2025 (ref. III PZP 1/25) – the Supreme Court found that the judgments of the Extraordinary Control and Public Affairs Chamber were not issued in accordance with the law due to the defective appointment of its judges. 6. Ilareva and Others v. Bulgaria – 9 September (ECtHR) – The Strasbourg Court created important safeguards for human rights defenders in the context of hate speech, criminal threats, and hate speech. 7. A.R. v. Poland (6030/21) – November 13 (ECtHR) – The Strasbourg Court has dealt with another case concerning the consequences of the Constitutional Tribunal's 2020 judgment restricting access to legal abortion in Poland. 8. Cupriak-Trojan v. Mazowieckie Voivode (C-713/23) – November 25 (CJEU) – The Luxembourg Court ruled that Poland must recognize same-sex marriages concluded in other EU countries. 9. Russmedia Digital (C-492/23) – December 2 (CJEU) – The Luxembourg Court ruled that social media platforms are liable for advertisements using images of individuals and deepfake technology. 10. Danileț v. Romania (December 15, 2025, Grand Chamber of the ECtHR) – The Strasbourg Court has defined the standards of freedom of speech for judges in the context of publishing content on social media. 11. Solidarity activists vs. Andrzej Zybertowicz – December 18 (Court of Appeal) – Final judgment defending the dignity of the Round Table participants. The court found that the unjustified stigmatization of opposition icons violates their personal rights. 12. Commission v. Poland (C-448/23) – December 18 (CJEU) – The Luxembourg Court found that the Polish Constitutional Tribunal in its current form (with its so-called understudies) is not an independent court within the meaning of European Union law.
