And section 6 of the Muslim Family Law Ordinance 1961 deals with matters of second marriage and the reasons for second marriage.The role of the reconciliation council of Concerned union council is very important in this regard. In the light of the decisions of the Federal Shariah Court and the Supreme Court, this law does not prevent second marriages but calls for adopting the procedure and demanding punishment for non-compliance. According to the amendment made on March 18, 2018, remarriage without permission is punishable by one year imprisonment and a fine of Rs 500,000 or both. And marriage without permission will not be registered in the Union Council. The most important point that the Chief Justice of the Islamabad High Court, Justice Athar Minallah, held in a recent decision that even if the first wife allows a second marriage, it is mandatory to seek permission from the Arbitrary council of the relevant union council.
