Our project "Analysis of Written Reports of a Criminal Case Specialist" is receiving a lively response from our audience. And that's encouraging! So, we continue. This time, attorney Oleg Valerievich Vikulov and I are focusing not only and not so much on the widespread violation of the law—the lack of grounds for conducting operational search activities (Article 7 of the Federal Law on Operational Search Activities)—but on the alleged falsification of operational search results by operatives. In the case we're analyzing, it's highly likely that the order to conduct operational search activities was drawn up AFTER they were conducted. It's regrettable not only that such violations and crimes are allowed. It's also unfortunate that lawyers often fail to recognize such violations and/or are unable to provide an accurate legal assessment of them and formulate effective arguments. The conversation will address: how operatives, unfortunately, conceal such violations and what investigators and prosecutors should do; How can lawyers identify this and prevent detectives from falsifying materials?
