Even if one member of the couple is not in Spain, it is possible to get married through a proxy marriage. WHAT IS A PROXY MARRIAGE? In short, a proxy marriage occurs when two people wish to marry but, for various reasons, are in different places or countries and cannot both be present at the ceremony. It is generally used to allow a Spanish citizen and a foreigner to marry, the latter of whom, for various reasons, has not been granted a visa to come to Spain or is not currently in Spain. In this way, they can marry thanks to a notarized power of attorney that substitutes for the physical presence of the partner who is far away. This entire procedure is specifically regulated in Article 55 of the Civil Code: (...)One of the contracting parties may marry through a proxy, to whom they must have granted special power of attorney in authentic form, always requiring the personal attendance of the other contracting party. The power of attorney shall specify the person with whom the marriage is to be celebrated, including the precise personal details necessary to establish their identity. Its validity shall be assessed by the court clerk, notary, registrar, or official processing the marriage certificate or file prior to the marriage. The power of attorney shall be extinguished by revocation by the principal, by resignation of the attorney-in-fact, or by the death of either party. In the event of revocation by the principal, a formal declaration of revocation before the marriage ceremony shall suffice. The revocation will be notified immediately to the court clerk, notary, registrar, or official processing the marriage certificate or file, and if the marriage has already been finalized, to the person who is to officiate the ceremony.
