PATAY NA ANG GUN OWNER. ANO ANG GAGAWIN SA BARIL, LISENSYA AT REHISTRO NITO?

Para sa iyong kaalaman, ating tatalakayin ang Republic Act No. 10591 o ang "Comprehensive Firearms and Ammunition Regulation Act of 2013". Sa nasabing batas: “SEC. 26. Death or Disability of Licensee. – Upon the death or legal disability of the holder of a firearm license, it shall be the duty of his/her next of kin, nearest relative, legal representative, or other person who shall knowingly come into possession of such firearm or ammunition, to deliver the same to the FEO of the PNP or Police Regional Office, and such firearm or ammunition shall be retained by the police custodian pending the issuance of a license and its registration in accordance, with this Act. The failure to deliver the firearm or ammunition within six (6) months after the death or legal disability of the licensee shall render the possessor liable for illegal possession of the firearm.” Kaugnay nito, nakasaad sa Implementing Rules and Regulations ng nasabing batas na: “Section 26. Death or Disability of the Licensee 26.1 Upon the death of the licensee, the privilege of his/her license to own or possess firearms and the registration of the firearm automatically expires. 26.3 When a licensed citizen with registered firearm dies or become legally disabled, his/her next of kin, nearest relative, legal representative, or any other person who shall knowingly come into possession of the registered firearm shall cause the delivery of the same to the FEO or Police Regional Office or through the nearest police station which has jurisdiction over the licensee and/or the registered firearm.” Ayon sa mga nabanggit na probisyon ng batas, kapag namatay ang may-ari ng baril ay automatic na mawawalan ng bisa ang kanyang lisensya at rehistro ng kanyang baril. Kaakibat nito, mayroong mabubuong obligasyon ang pinakamalapit na kamag-anak, kinatawan o sinumang mamamahala sa nasabing baril na dalhin at isuko ito sa kapulisan sa loob ng anim na buwan mula nang pagkamatay ng may-ari ng baril. Kung hindi ito magawa, maaaring makasuhan ng illegal possession of firearm ang may hawak ng nasabing baril. Kaya, kinakailangan mong dalhin ito sa Firearms and Explosive Office (FEO)sa Camp Crame o sa Police Regional Office o sa pinakamalapit na police station na nakasasakop sa lugar ng iyong lugar.
