Who can obtain a conditional right to practice nursing? Any person, regardless of nationality, who has obtained the qualification of a nurse or midwife outside the European Union and meets the following conditions: 1. holds a diploma of a nurse or midwife; 2. has full legal capacity; 3. has a state of health allowing to work as a nurse or midwife; 4. demonstrates impeccable ethical attitude. How to resolve the issue and what documents to present: Submit a personally signed application to the Minister of Health and all the following documents required for its consideration (number the attached documents by serial number) the number is indicated in the application, translations mark the documents with the letter a): 1) a statement of the following content: "Recognizing the criminal liability for giving a false statement, I declare that I have full legal capacity" (the declaration must indicate your last name and first name, place and date of the statement, as well as your legible signature); 2) a document issued by a doctor confirming that you have a health condition that allows you to work as a nurse or midwife. This document can be issued by either a Polish doctor or a doctor from your country of origin, but it must then be translated into Polish by a sworn translator (remember that the document can be submitted within 3 months from the date of its issue, which means that the decision is valid for three months from the date of its issuance); 3) the following documents confirming impeccable ethical attitude: a) Document 1: A statement with the following content: "Being aware of the criminal liability for submitting a false statement, I declare that I have not been punished for an intentional crime or an intentional financial crime and that no criminal proceedings have been instituted against me for an intentional crime or a financial crime, and that there are no circumstances which, in accordance with the Code of Professional Ethics of Nurses and Midwives of the Republic of Poland and other legal acts within the meaning of the requirement specified in Art. 35a point 1 point 5 of the Act of 15 July 2011 on the professions of a nurse and a midwife (Journal of Laws of 2020, item 562, as amended), may affect the exercise of the profession of a nurse or midwife in the territory of the Republic of Poland." (the declaration must also indicate your last name and first name, place and date of the declaration, and your clear signature). b) document 2 (if available in the given country of origin of the nurse or midwife): A document confirming your professional purity and compliance with ethical requirements, issued by an authorized body in the country where you worked / worked as a nurse or midwife; In case of difficulties in obtaining this document, it is necessary to make a declaration: “I declare that it is not possible to obtain a document certifying professional conduct and compliance with the requirements regarding ethical attitude, issued by a competent body in the country in which I have practised or exercised my profession due to ……… (Indicate the reason).” (The declaration must also indicate the surname and first name of the nurse or midwife, the place and date of submission of the declaration and the signature.) 4) a document issued by a competent body abroad (e.g. the current employer or a professional self-government body), certifying that you have at least three years of professional experience as a nurse or midwife, obtained during the five years immediately preceding the date of submission of the application. 5) a diploma of a nurse or midwife. An applicant for a nurse or midwife to apply for a conditional right to practice the profession of a nurse or a conditional right to practice the profession of a midwife during the declaration of an epidemic threat or epidemic in Poland is not required to legalize diplomas or duplicates and have an apostille of diplomas or duplicates. 6) possibly other documents confirming the possession of additional professional qualifications issued by a competent authority. Attach translations of foreign documents into Polish, translated by a sworn translator in accordance with the Act of 25 November 2004 on the profession of a sworn translator (Journal of Laws of 2019, item 1326).
