Rebecca Grossman's Lawyer Questions Scott Erickson In Iskanders' Wrongful Death Trial
After six hours of questioning from Brian Panish over two days, Rebecca Grossman's lawyer kept her exam of Scott Erickson short on Wednesday. Esther Holm, a partner at Lewis Brisbois Bisgaard & Smith LLP, began by asking Erickson about his romantic relationship with Grossman to try to show it wasn't a secret affair like plaintiff's attorney Brian Panish implied in his direct-exam. Grossman is in prison for killing 11-year-old Mark and 8-year-old Jacob Iskander on Sept. 29, 2020.. Holm is trying to show in this civl wrongful death trial that Erickson is responsible for the crash. 01:00 "Were you comfortable being seen together in public? You and Rebecca Grossman?" "Yes, we were." "So is it fair to say that this was not a secret affair?" "Yes, it is." 01:44 "And you had one margarita that was waiting for her when she arrived?" "True." "I don't recall." "Do you recall that you had ordered the drinks before Ms. Grossman got there, and it was waiting for her when she arrived?" "I don't exactly recall that." 02:33 "Was there anything about her demeanor that you thought she looked impaired?" "No." "Did she slur her speech?" "No." "Did she walk in an unsteady way?" "No." 02:55 "After the accident, did Ms. Grossman ever ask you not to say she was drinking?" "No." "Did she ever ask you to lie?" "No." "Before you left Julio's, did you have any discussion with Ms. Grossman about racing?" "No." 04:30 "So do you recall that until you get to about that turn lane, you really can't see straight to the sidewalk?" "Yes." 06:06 "Is it correct, Mr. Erickson, you only passed the one car, so those other two cars you had seen would have still been behind you somewhere?" Judge Huey Cotton agrees with Panish that Holm can't ask leading questions because Erickson was called as an adverse witness, so Panish did the leading. 06:48 "Now as you approach the intersection, did you see any of the children?" "Yes." "And what did you see?" "Two young boys towards the divider, and some look like scooters." 07:30 "How far were you from the intersection when you saw the two boys, 20 to 30 yards?" "And how many feet would that be?" "Up to 90 feet." 08:01 "Did you see the mother as you were approaching the intersection?" "No, I did not." "Did you see Zachary who was on the scooter?" "No." 09:46 "Now as you were approaching the intersection, did you honk the horn?" "No, I did not." "Did you flash your lights?" "No, I did not." "Did you do anything to try to warn the children that you were approaching?" "No, I did not." 10:26 "Would you agree that if a car was traveling behind your black SUV, that it could block the vision of any car driving behind your car?" foundational objection sustained 19:47 "Did you look in your rear view mirror after you passed the intersection?" "Yes, I did." "Did you see any cars?" "I did not see any cars." "There were cars behind you, though, true?" 20:26 "And while you're watching this video, let's count the number of cars." 21:30 "After the accident, you testified earlier you had a phone call. You recall that?" "Yes, I did." "And you testified that Rebecca called you, correct?" "Yes." "Do you remember precisely what she said?" "Something bad happened." "And do you recall precisely what she said about about kids?" "Oh, kids, and hung up." 23:14 "Did the police ever inspect either of your vehicles?" "No, the police do not." "Did the police ever ask you to produce your vehicles?" "No, they did not." "And do you recall precisely what she said about about kids?" "Oh, kids, and hung up." 23:53 "Did you tell Royce Clayton that you and Rebecca were racing at high speed?" "No, I did not." "Were you racing?" "No, I was not." "You were not charged with racing under the vehicle code. Is that correct?" "Yes." "And you testified here that you were charged with reckless driving. Is that correct?" "Yes." 25:15 "Did Rebecca Grossman ever tell you she saw the kids before entering the intersection?" "No, she did not."
