Matthew Hassim SC introducing documentary evidence relating to Adriano Mazzotti, Carnilinx (Pty) Ltd, the tobacco industry and historical interactions with SARS. The hearing began with Hassim reading into the record a signed submission voluntarily provided by Adriano Mazzotti on behalf of Carnilinx. According to the submission: Carnilinx states that it is not seeking to shield corruption. The company says it intends to place the relevant legal and factual background before the Commission. Carnilinx confirms it is a licensed South African cigarette manufacturer. The company says it complies with South African tax laws and regulatory requirements. It states that it employs more than 100 South Africans. Carnilinx says it is a member of the Tobacco Institute of Southern Africa (TISA). The company maintains that it opposes the illicit tobacco trade. The submission disputes aspects of historical SARS-related allegations and argues that a confidential affidavit submitted to SARS later entered the public domain without the necessary context. The hearing also revisited the history of Carnilinx, whose founders have featured prominently in South Africa's political, tax and law-enforcement controversies. Carnilinx was co-founded by Adriano Mazzotti, the late Kyle Phillips, and Mohamed Sayed. Over the years: Adriano Mazzotti became widely known for financially supporting the launch of the Economic Freedom Fighters (EFF), publicly confirming that he contributed R200,000 towards the party's registration in 2013–2014. The late Kyle Phillips was reported to have loaned R1 million to assist Julius Malema in settling outstanding tax obligations with SARS. Mohamed Sayed has served as Carnilinx's Chief Operating Officer and has represented the company publicly on numerous occasions. Carnilinx and some of its directors have, over the past decade, been the subject of multiple investigations and public allegations involving: historical SARS tax disputes; allegations concerning the illicit tobacco trade; alleged money-laundering activities; alleged corporate espionage involving the tobacco industry; and alleged interactions with former Crime Intelligence head Major-General Feroz Khan. During the Commission, documentary evidence also examined historical WhatsApp communications and other records involving Khan.
