In recent days, the idea has begun circulating that the United States will have a new immigration points system in 2026. According to this rumor, family ties would no longer be the only factor considered; education, English proficiency, age, work experience, and a job offer would also be taken into account. But be aware: There is currently no approved immigration points system in the United States. There is no final law. There is no official announcement from USCIS. There is no implementation date. Family-based petitions, residency through marriage, petitions for children, parents, siblings, and employment categories continue to operate under the current rules. THE RUMOR DIDN'T COME OUT OF NOWHERE Although there is no points system in effect, the idea has been around for years. Countries like Canada, Australia, and the United Kingdom use models where immigrants receive points for education, language skills, work experience, age, and job offers. This system rewards a person's economic profile. The United States, on the other hand, has based much of its legal immigration on family reunification. That's why this debate is so important: There are political sectors that want to reduce family-based immigration, eliminate the visa lottery, and move the system toward a merit-based model. IT HAS BEEN ATTEMPTED BEFORE This isn't new. In 2013, an immigration reform bill attempted to create merit-based visas, but it failed in Congress. In 2017, during Trump's first term, the RAISE Act was introduced, a proposal that sought a Canadian-style points system, eliminated the visa lottery, and reduced family-based petitions, such as those from siblings and married children of citizens. Trump supported this idea, but it also failed to pass. The reason is simple: A president cannot change the entire immigration system by decree. To create a points-based system, a law passed by Congress is required. WHAT IS MOVING What is real is that groups close to the America First agenda are pushing proposals to reform legal immigration toward a merit-based system. This means giving more weight to skills, education, English proficiency, work experience, and economic self-sufficiency. It's not law yet. But it shows where they want to push the debate if Republicans have a majority in Congress. RETROACTIVE REVIEW: THIS IS REAL While everyone is talking about the points-based system, there is another, much more immediate change. USCIS and DHS are more rigorously reviewing already approved immigration cases, especially when there are concerns about fraud, security, false information, background checks, or countries considered of concern. They have also strengthened reviews of social media, opinions considered extremist, moral character, and background checks. This doesn't mean millions of residents will lose their Green Cards tomorrow. But it does mean that cases with errors, lies, omissions, or questionable backgrounds may be under scrutiny again. WHAT CONDUCT CAN COMPLICATE YOUR STATUS First: False or omitted information on past applications. A questionable marriage, incorrect income, an undisclosed arrest, or inconsistent documents can cause problems years later. Second: Criminal records, including charges that resulted in no conviction, especially if they were not disclosed. Third: Extended trips outside the United States. Absences of more than six months can raise questions about abandonment of residency. More than a year without permission to re-enter can be even more serious. Fourth: Tax problems. Failing to file taxes, filing as a non-resident while being a permanent resident, or having tax inconsistencies can affect your good moral character and residency record. Fifth: Fingerprints, FBI checks, and a new background check. If something didn't show up before, it might now. YOUR BEST DEFENSE: YOUR IMMIGRATION HISTORY FILE The most important recommendation is to keep a personal file with your entire immigration history. Keep copies of all your immigration applications. Receipts, approvals, work permits, Green Card, I-94, previous and current passports. Keep travel records with departure and arrival dates. Keep tax returns for every year. Keep proof of continuous residence, such as rent, mortgage, utility bills, bank statements, and pay stubs. If you had any cases with the police or the courts, request certified dispositions showing how they ended.
