In 1917, there was a revolution in Russia, one of the causes of which was the disagreement between capitalists and workers. Since then, close attention has been paid to labor relations. Discussion of Lecture Question 1 Labor law is the branch of law that regulates the relationship between employee and employer. Labor law is the state's intervention in labor relations. The state establishes strict control over the relationship between employer and employee. Functions of labor law: · Production – ensures production with labor (employer's rights) · Protective – social protection of the employee The subject of labor law is the relations that labor law regulates. The characteristics of labor relations are: 1) Payment – ​​characterized by periodicity, i.e., the employee must receive payment after a certain period of time. 2) Personal – the employee must personally perform their duties, i.e., He cannot rehire anyone. 3) Work schedule – there is an employment contract and instructions that specify what the employee is required to perform. Types of labor relations: 1) Labor relations – teacher and university 2) Relations closely related to labor relations – issues of professional training, labor disputes, social security, etc. Discussion of lecture question 2: An employment contract is an agreement between an employee and an employer. An employment contract is always in writing (an employee can, through the courts, force the employer to enter into an employment contract with them if the employee has commenced their duties). Termination of an employment contract: 1) At the employee's initiative (the employer must be notified 2 weeks prior to dismissal) 2) At the employer's initiative: · Liquidation – bankruptcy of the company · Downsizing – a decline in production volume · Certification – checking the employee's compliance with the employer's requirements · Absenteeism – absence from work for more than 4 hours without a valid reason · Intoxication – being at work while intoxicated · Theft – theft from the workplace Discussion of Lecture Question 3: Working Hours: 1) Must be no more than 40 hours per week 2) Reduced working hours (for children, disabled people) 3) Part-time work (reduction of working hours due to pregnancy) 4) On the eve (shortened working day by 1 hour) Before weekends/holidays) 5) Nighttime (if work falls at night, it is shortened by 1 hour) Rest time: 1) Break (from 30 minutes; unpaid) 2) Warm-up break (for some types of work) 3) Weekly rest (at least 42 hours; 1 day off for a 6-hour workday, 2 for a 5-day workday) 4) Holidays (prescribed in the Labor Code) 5) Vacation (at least 28 days; 2 responsibilities of the employer: maintaining the job, payment of wages) Discussion of Lecture Question 4: Payment: 1) Remuneration (basic salary) 2) Compensation (harmful working conditions) 3) Incentives (bonuses) Discussion of Lecture Question 5: Responsibility: · Disciplinary (warning/reprimand/dismissal) – the employee fails to fulfill their job responsibilities · Material – the employee caused material damage to the company Discussion of Lecture Question 6: Supervision and control (state monitoring of the employer). There are three authorities to which an employee can file a complaint against an employer: · Court · Labor Inspectorate · Prosecutor's Office These three bodies oversee and monitor labor legislation. Discussion of Lecture Question 7: Labor Disputes: 1) Individual – the employee sues the company over a conflict 2) Collective – the team files a claim against the employer (without going to court) Assignment for the training section: Write an answer to the question "Is it considered absenteeism if a teacher didn't attend online classes with students, but added assignments remotely?" Training section of the lesson One student in a team group is asked to voice their answer options and choose which one they believe is incorrect. Another student may refute this point of view, supporting it with appropriate arguments.
