Enforcement of Attorney's Fees - Law 15.109/25 Law 15.109/25 amended Article 82 of the Code of Civil Procedure, including its third paragraph, which now reads as follows: Article 82. Except for provisions concerning free legal aid, the parties are responsible for covering the expenses of any acts they perform or request in the proceedings, paying them in advance, from the beginning until the final judgment or, in the case of execution, until the right recognized in the title is fully satisfied. § 1. The plaintiff is responsible for paying in advance the expenses related to any act the judge orders ex officio or at the request of the Public Prosecutor's Office, when its intervention is as a legal guardian. § 2. The judgment shall order the losing party to pay the winning party the expenses they paid in advance. § 3. In collection actions involving any procedure, whether common or special, as well as in executions or enforcement of judgments for attorneys' fees, the attorney will be exempt from paying court costs in advance, and the defendant or defendant will be responsible for paying them at the end of the proceedings, if they initiated the proceedings. Therefore, attorneys will no longer have to pay court costs for filing enforcement actions or enforcing judgments for their attorneys' fees.
