It establishes a right to information for fee payers, establishing a new level of accountability for public broadcasters. From an economic perspective, this decision transforms fee payers from passive financiers to principals with enforceable information claims against their agents, the broadcasters. 1. The Right to Information as a Corrective to Market Failure In a regular media market, viewer preferences and advertising revenues signal a provider's performance. Public broadcasters lack this pricing mechanism. Compulsory funding creates a classic principal-agent problem, in which the agent (the broadcaster) is not directly accountable to the principal (the fee payer) for its output quality. The new Right to Information acts as an institutional corrective here. It obliges broadcasters to disclose the extent to which they actually fulfill their legally defined mandate – providing diversity, inclusion, and balance. This annual accountability regarding program composition and content is essential for measuring and ensuring the quality of the public good "licence-funded programming." Until now, broadcasters have operated in an information-economic vacuum in this regard, which could lead to inefficiencies and a lack of legitimacy. 2. Overcoming the evidentiary hurdle through scientific media content analysis The legal hurdle of proving a "structural, permanent, and significant" deficit appears high at first glance. From a scientific perspective, however, this hurdle is not only sensible but also surmountable. The requirement for long-term evidence corresponds to the economic and social science principle that only comprehensive surveys allow meaningful conclusions about systematic bias. The decisive innovation of the ruling lies in the implicit recognition of scientific media content analyses as valid evidence. Instead of anecdotal evidence or private tally sheets, systematic, replicable, and peer-reviewed long-term studies can now be used. Research institutes and universities (e.g., Mainz and Munich) have been generating data quantifying structural asymmetry in media reporting for years.
